The Somalian Ministry of Women and Human Rights Development, together with the appropriate managers, is responsible for interpreting, implementing, monitoring, and ensuring compliance with these policies. Related operating procedures and policy exceptions are the responsibility of the Ministry leadership and Admin Unit.

Other Updates Progress

Commitment year: 2018

The Government of Somalia acknowledges the need to include the rights of PwD in the new constitution to ensure a more inclusive society. In addition, the FGS commits itself to ensure better political participation of PwDs in the context of the electoral process towards the 2021 elections. Somalia believes that PwDs must have a voice in these two important processes.

On May 13, 2018, Somalia officially launched the process of reviewing the Provisional Federal Constitution. The process is coordinated by the Ministry of Constitutional Affairs (MoCA).  The Ministry of Women and Human Rights Development have collaborated with MoCA in mobilizing inclusion and effective participation of Somali persons with disabilities; who have made concrete proposals on entrenching disability rights in the Constitution.

Women and Girls with Disabilities Updates Progress

Legislation and policies to increase social services inclusion of women and girls living with a disability 

Timeframe and/or implementation plan
Women and girls experience compounded double discrimination and marginalization in unique circumstances of conflict and emergence from fragility such as prevailing in Somalia. The FGS commits to fast tracking the enactment of the Sexual Offences Bill which is currently before Parliament as well as to the finalization of the Gender and Disability policies to inform increased access to social services including access to justice for women and girls with disabilities.

The Federal Government of Somalia has three Bills relating to women and girls. These are the Sexual Offences Bill which is currently before Parliament for debate and approval; the FGM Bill which is under preparation and is due to be introduced in Parliament and the Child Rights Bill which is also due to be introduced in Parliament. Data Disaggregation Updates Progress

Commit resources to support strengthened disability data
The FGS commits to adopt the ‘Washington Set of Questions’ in the design of its population census instruments and ensure demographic data collected is disaggregated by gender, age and category of disability. This will be in addition to allocation of more resources to gather more disability data to improve legislation and policy in this area.

The Federal Government of Somalia commits to formulating a policy framework to facilitate and enhance access to affordable relevant quality assistive technology for PwDs, and establishment of a Coordination Centre/Hub for various stakeholders and partners including inventors and institutions of learning to regulate quality and standards of assistive technology

In December 2018, the President of the Federal Republic of Somalia signed into law a Bill establishing the National Disability Agency whose mandate include facilitating access to assistive devices and technology by PWDs.

Routes to Economic Empowerment Updates Progress

Skills development for decent work
The FGS commits to establish livelihood and vocational training centres to provide rehabilitation, work-oriented and entrepreneurial skills training and formal education for PwDs in general and with a focus on women and youth. Partnerships with private sector will be facilitated to enhance equal access to credit. FGS further commits to support creation of PwD owned small-scale businesses for poverty reduction and ways of improving access to financial services and infrastructure in compliance with universal design.

 The Federal Government of Somalia has established the National Disability Agency by law. This agency has the mandate of facilitating skills training for PWDs to access economic opportunities including access to startup capital and financing from financial institutions through Public Private Partnerships.

Inclusive Education Updates Progress

Inclusive education sector plans
In June 2018, the Federal Government of Somalia approved establishment of the first ever National Disability Agency. Enactment of a National Disability Bill (in line with the CRPD) will follow to set out PwDs’ political, educational, economic and social rights. The FGS commits to expedite enactment and implementation of this law and finalization of a national disability policy to address better inclusion in the area of accessibility to the built environment and education for PwDs.

The process of developing the national disability law has been initiated. In addition to the envisaged law, the FGS has put in place a framework for the visually impaired to sit national examinations in accessible formats. Eliminate Stigma and Discrimination Updates Progress

Policy, legislation and its implementation
The Federal Government of Somalia commits to entrench the rights of PwDs in the Federal Constitution outlawing discrimination and developing a multi-dimensional disability inclusion strategy to eradicate systemic stigmatization.  A short-term strategy will be positive discrimination for PwDs and uniform public sensitization Focus will be on women and girls who experience double stigma and discrimination; children, youth in their working age, in line with the slogan ‘Nothing about us, without us’
